Minutes of Meeting
Thursday, March 9, 2006

A regular meeting of the Salem Conservation Commission was held on Thursday, March 9, 2006 at 6:00 p.m. in the third floor conference room at 120 Washington Street.

Those present were:  Kevin Cornacchio, Keith Glidden, David Pabich, Kevin Carr and Michael Blier. Also present was Frank Taormina, Conservation Administrator and Eileen Sacco, Clerk

Members absent: Joe Furnari

Approval of Minutes

The minutes of the Salem Conservation Commission meeting held on  February 23, 2006 were presented for approval.  Joe Furnari moved approval of the minutes of February 23, 2006 as presented, seconded by David Pabich and approved  (5-0).

Continuation of Public Hearing - DEP # 64-385- AAA Tree Services - 120 Swampscott Road - The Purpose of this Hearing is to discuss the Proposed Site Work within the Buffer Zone to an Inland Bank and Bordering Vegetated Wetland

Kevin Cornacchio read a letter from Gulf of Maine Research Inc. requesting that the matter be continued to March 23, 2006.  David Pabich moved to continue the public hearing to March 9, 2006, seconded by Kevin Carr and approved (5-0).

Public Hearing – Abbreviated Notice of Resource Delineation- Leo Higgins – Purpose of Hearing is for a Determination of Wetland Boundary Line off Story Street

Kevin Cornacchio read a letter from John Dick of Hancock Environmental requesting that the matter be continued to March 23, 2006.  Kevin Carr moved to continue the public hearing to March 9, 2006, seconded by Keith Glidden and approved (5-0).

Old / New Business

Discussion with Owner of 21 Parallel Street

The Commission held a discussion with Mr. Warford the owner of 21 Parallel Street regarding complaints that he has been clearing the land on his property without the approval of the Commission.

Frank Taormina explained that he sent two violation letters to Mr. Warford last year when it was reported that there was a bobcat on the site and clearing and grubbing was taking place on the property, and now there is another complaint of more recent activity taking place on the site.  He referred to the Order of Conditions issued in 1997, which states that minimal or no activity shall take place in the buffer zone.  He noted that he included a copy of the deed and the Order of Conditions in the letters that were sent.

Kevin Cornacchio questioned Mr. Warford on whether he got the information when he purchased his house.  
Mr. Warford stated that he was storing logs on his property that he got some place else.  Kevin Cornacchio noted that it looks like trees were cut down on the property.

Frank Taormina noted that the pictures show that activity in that took place last year.  Mr. Warford stated that there was illegal dumping on his property.  He also stated that he has not touched anything outside of the hay bales on the property.

Kevin Cornacchio asked Mr. Warford what his intent is with regards to the site.  Mr. Warford stated that he has no intent.  Kevin Cornacchio informed Mr. Warford that he approval from the Conservation Commission before he does any work on the site.

Mr. Warford stated that he was told to stop working on the site and he did.  He stated that he called Frank Taormina who told him to come in with a plan.

Kevin Cornacchio stated that Mr. Warford needs to file a Notice of Intent with the Commission.

Frank Taormina suggested that the Commission issue an Enforcement Order.  Kevin Cornacchio agreed and suggested that the Commission visit the site.

There being no further questions or comments regarding this matter a motion was made by Keith Glidden to issue an Enforcement Order for 21 Parallel Street, and continue the matter to the next meeting, seconded by Kevin Carr and approved
(5-0)

Public Hearing – Notice of Intent – DEP #64-410 – 96 Swampscott Road – Swampscott Road LLC – Limited Site Improvements and the Expansion of Parking Lot Within a Riverfront Area and a Buffer Zone to a Bordering Vegetated Wetland

Scott Patrowicz addressed the Commission and noted that the Commission visited the site and asked if the Commission has any questions.

Keith Glidden asked if the slope was going to be cleaned.  Mr. Petrowicz stated that they need the Order of Conditions before they can get in there and clean it out.

Michael Blier noted that the project is pretty straightforward and he had no concerns.

Kevin Cornacchio opened the hearing up for public comment at this time.  There was no one present who wished to comment on the matter.

There being no further questions or comment regarding this matter a motion was made by Keith Glidden to close the public hearing, seconded by Michael Blier and approved (4-0-1), with Kevin Carr abstaining.

David Pabich moved to issue a standard order of conditions, seconded by Michael Blier and approved (4-0-1)


Public Hearing – Notice of Intent DEP #64-411 – 9 Harborview Terrace – Robert Heiskell – Proposed Addition to a Single Family House within a Buffer Zone toa Coastal Bank

Frank Taormina explained that the Commission couldn’t take action on this matter this evening because there are not enough members present who participated in the public hearing at the last meeting.  He suggested that due to scheduling conflicts the Commission could hold a special meeting for the purpose of approving this matter so that applicant won’t have to wait until April for approval.

There being no further questions or comments regarding this matter, a motion was made by Keith Glidden to continue the public hearing to March 23, 2006, seconded by Michael Blier and approved (5-0).

Old / New Business Continued:

Transfer Station

Kevin Cornacchio explained that he and Frank Taormina met with Robbie George and Bruce Thibodeau regarding the transfer station.  He showed members the plans that are in process for the transfer station and the improvements that they are planning for the site.

Adjournment

There being no further business to come before the Commission this evening a motion was made by Keith Glidden to adjourn the meeting, seconded by Kevin Carr and approved. 5-0).

The meeting was adjourned at 6:45 p.m.
